Terms of Service for the Sport Clips Check-In Online App

Welcome to the Sport Clips Check-In Online App ("the App"), provided by Sport Clips, Inc. ("SCI"). These Terms of Service govern your access to and use of the App, including any content, functionality, and services offered through it. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App. By using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

1. Acceptance of Terms. By accessing or using the App, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into these Terms. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of the App. The App allows users to check in to chosen Sport Clips store locations, and schedule services. We may update or modify the App's features at our discretion without prior notice.

3. Account Registration and Security. To use certain features, you will need to create an account by providing accurate and complete information, such as your name, email address, or phone number. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use of your account. SCI reserves the right to suspend or terminate your account if you violate these Terms of Service or engage in activities that harm the App or other users.

4. User Conduct. You agree to not (a) scrape the App without SCI's express permission, (b) use the App for any illegal or unauthorized purpose, (c) interfere with the App's functionality, including the introduction of viruses, malware, or other harmful code, and (d) collect or harvest personal information from other users without their explicit and written consent.

5. Privacy. Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the App, you consent to the practices described in SCI's Privacy Policy located at https://sportclips.com/legal/privacy-policy.

6. Intellectual Property. Our Content: The App, including its design, code, graphics, and text, is owned by or licensed to SCI and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without SCI's prior written consent.

7. Third-Party Services. The App may integrate with third-party services such as maps and payment processors. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of such services is subject to their respective terms and policies.

9. Termination. You may stop using the App at any time and delete your account through the App's settings, if available. SCI may suspend or terminate your access to the App at our discretion, with or without notice, for reasons including but not limited to violation of these Terms or inactivity.

10. Disclaimers. The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the accuracy, reliability, or completeness of any information provided through the App, including location data or user-generated content.

11. Limitation of Liability and Indemnification. To the fullest extent permitted by law, we and our officers, employees, affiliates and agents are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. You agree to indemnify and hold SCI harmless from any claims, losses, or damages, including reasonable attorneys' fees, arising from your use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Modifications to Terms and Governing Law. SCI may update these Terms at any time by posting the revised version on the App or our website. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

13. Governing Law. These Terms are governed by the laws of Texas, without regard to its conflict of laws principles. Any disputes arising from these Terms will be resolved in the courts of Texas.

16. Miscellaneous. SCI's failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
